Welcome to Everyday SAS (“Everyday,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and Everyday governing your use of our mobile games, websites, and related online services (collectively, our “Services”).

By downloading, accessing, or using our Services —or by clicking “Accept” or a similar button — you agree to be bound by these Terms. If you do not agree, you must stop using our Services immediately.

We may update these Terms periodically to reflect changes in our business, services, or legal requirements. We will notify you of material changes by updating the date above and may also provide additional notice in-app or via email. Continued use of our Services after the effective date means you accept the revised Terms.

If you breach these Terms, we may suspend or terminate your access to our Services.

Your privacy matters to us. Please review our Privacy Policy to understand what personal data we collect, how we use it, and your rights and choices under applicable laws. By using our Services, you acknowledge that your data will be processed as described there.

Children under 13 years old (or under 16 in certain regions such as the EEA) may not use our Services.

If you are between 13 and 18 (or the age of majority in your country), you must have the consent of a parent or legal guardian to use our Services. By allowing a minor to access our Services, the parent or guardian agrees to be responsible for the child’s use and to ensure compliance with these Terms.

You agree to use our Services only for lawful and personal entertainment purposes. You must not:

• Use our Services in violation of any applicable law or regulation;
• Create an account on behalf of another person or using false information;
• Sell, rent, trade, transfer, or share your account or any virtual items;
• Use our Services for commercial purposes without our written consent;
• Harass, threaten, or abuse other players or our employees;
• Upload content that is illegal, harmful, obscene, defamatory, hateful, or otherwise objectionable;
• Cheat, hack, exploit bugs, or use unauthorized software such as bots or mods;
• Interfere with, disrupt, or attack our servers or networks;
• Reverse-engineer, decompile, or modify any part of our Services;
• Encourage or assist others to do any of the above.

Violation of these rules may result in account suspension or termination without refund.

Our games may include virtual currencies, items, or features (“Virtual Items”). Virtual Items:

• Have no real-world value and cannot be redeemed for money;
• Are licensed to you for personal, non-commercial use only; and
• May be modified, suspended, or revoked by us at any time without compensation.

All purchases made through app stores are final and subject to the store’s payment terms. Except as required by law, we do not offer refunds for Virtual Items or in-app purchases.

You are responsible for all charges incurred through your account, including those made by unauthorized users of your device.

All rights, title, and interest in our Services —including games, software, graphics, music, characters, and other content—are owned by Everyday or our licensors.

You receive only a limited, non-exclusive, revocable license to use our Services for personal entertainment purposes. You acquire no ownership rights in our Services or Virtual Items.

Unauthorized use of our intellectual property (including our logos and trademarks) is strictly prohibited.

If you share text, images, videos, feedback, or other materials (“User Content”) through our Services, you grant Everyday a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, reproduce, adapt, publish, translate, and display such User Content for any purpose related to our Services.

You must not upload User Content that violates laws or third-party rights (including intellectual property or privacy). We reserve the right to remove any User Content at our sole discretion.

All fees and prices displayed in our Services are in the currency set by the app store and include applicable taxes unless stated otherwise.

To the extent permitted by law, payments are non-refundable and non-transferable. We may change our offers, content, or features at any time without notice.

If your account is terminated due to a breach of these Terms, you will forfeit access to any Virtual Items or progress.

Subject to your compliance with these Terms and our policies, Everyday grants you a personal, non-exclusive, non-transferable, revocable license to access and use our Services for non-commercial entertainment purposes. We may modify or withdraw access at our discretion where permitted by law.

If you believe that any content in our Services infringes your copyright, please notify us at legal@joineveryday.com with:

1. Identification of the copyrighted work;
2. Identification of the infringing material and its location;
3. Your contact information; and
4. A statement under penalty of perjury that you are authorized to act on behalf of the rights holder.

A. If You Reside in the EEA or UK

We are liable only for losses that are reasonably foreseeable as a result of our breach of these Terms or negligence. Nothing in these Terms excludes liability for death, personal injury, fraud, or gross negligence.We may suspend or terminate your access if you materially breach these Terms or if required by law. You may appeal any such decision by contacting us at legal@joineveryday.com.

B. If You Reside Outside the EEA or UK

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYDAY AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYDAY SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. IN ANY CASE, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT CAUSING THE CLAIM.

All Everyday trademarks, logos, and game titles are the exclusive property of Everyday SAS or its affiliates. Unauthorized use is strictly prohibited.

A. Governing Law

These Terms and any disputes arising from them shall be governed by the laws of France, without regard to conflict of law principles.

B. Jurisdiction and Arbitration

If you reside in a jurisdiction that recognizes mandatory arbitration, you and Everyday agree that any dispute shall first be resolved through informal negotiation. If not resolved within 60 days, the dispute may be submitted to binding arbitration in accordance with the rules of the International Chamber of Commerce (ICC) in Paris, France.

You may opt out of this arbitration provision within 30 days by sending a signed notice to legal@joineveryday.com.

If arbitration is not legally permitted in your jurisdiction, the competent courts of Paris, France will have exclusive jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

We shall not be liable for delays or failures to perform caused by events beyond our reasonable control, including acts of God, war, pandemics, natural disasters, strikes, or government actions.
